Are you surprised to hear that there has been an increase in refusal to test rates among FMCSA drivers? According to American Substance Abuse Professionals, Inc. (ASAP), refusal to test rates for Department of Transportation (DOT) Federal Motor Carrier Safety Administration (FMCSA) drivers ended up with startling statistics in 2020. According to their data, increases included refusal to test at 60% for pre-employment and 44% for random.
These rates are surprising because a refusal to test has the same consequences of failing a drug test. The employee will need to go through the return to duty process, and it is the responsibility of the employer to provide the employee with a list of DOT Substance Abuse Professionals (SAP).
